A Delhi court arrested city police for filing two separate indictments in the alleged rape case of a 14-year-old girl, noting that “it’s a big slap on the logo of Delhi Police of “Shanti, Seva, Nyay”.

At the previous hearing (November 8), the court noted the differences between the charge sheets given to the court and to the victim’s lawyer.

While part of the indictment was filed with the court and the lawyer for the accused, the other part was filed with the public prosecutor and the lawyer for the plaintiff, who are said to have omitted facts.

Finding that the police were violating the accused’s right to a fair trial, the court ordered the police commissioner to initiate an investigation and to register a complaint against the police for “fraud of justice”.

On November 17, while hearing the accused’s bail application, the Deputy Police Commissioner filed a report indicating that an indictment without correction had been issued to the complainant and that it was an inadvertent error without bad faith intent. However, the court said he had been “misled”.

The accused was arrested in March this year for allegedly raping and kidnapping the minor in south Delhi.
